The state Elections Division will impose a financial penalty on an Albany Area Chamber of Commerce subcommittee for failing to report two contributions in last May's primary election.
Elections compliance specialist Kathy Schamp said Monday the amount to be assessed the Good Government Council political action committee will be determined later this year. She did not speculate on when this year, saying "we're working on 2006 violations now."
Schamp said there would be no hearing to determine the penalty, rather the state's computer system will figure out the amount. The total will be based on how long after the required filing date the information was received.
She said she had no idea what the amount could be.
Schamp said the PAC would not be penalized for failing to provide the Elections Division with updated information about its organization. The reason is because it was a first-time violation. The group had failed to name the person designated to receive communications or provide the names of all directors and the date they took office.
The council also was asked to explain in writing why it had not filed any transactions since 2006.
An investigation into possible violations began last year after a letter from an Albany resident alerted the elections office that the PAC had failed to report contributions to two Linn County Commissioner candidates during the primary.
The candidates, Roger Nyquist and Will Tucker, declared the contributions of $1,000 each on their campaign and expenditure reports.
PAC chairman Bill O'Bryan said at the time the matter was simply a housekeeping problem. He said the PAC would have all of the information requested to the elections office within a few days. That was done, Schamp said.
O'Bryan also said then that in the 10 years of the council's existence, there never had been a problem with financial reporting. "The council's integrity is without question," he said.
Schamp said it was not "unusual" for committees to file their transactions late.
