Closed shop: Strippers quit strip mall in Albany

The controversial Pussycats Private Adult Entertainment business at 919 Ninth Ave. S.E. in Albany has closed.

A sign on the door says the business has moved to Salem. The owner, Ben Cunningham of Salem, has a similar operation there.

Pussycats had opened in Albany on Jan. 2.

After a one-day trial on April 17, Linn Circuit Court Judge Glen Baisinger ruled on May 1 that the owner of the building had enough reasons to ask the court to evict the business.

At the non-jury trial, Albany attorney Andrew Noonan had argued that Cunningham deceived the property owner, Michael Fredette, formerly of Albany and now of Washington, about what would go on in the 500-square-foot space in the mini-strip mall.

Salem attorney Kevin Lafky, who represented Cunningham, indicated he would appeal. Lafky said at the time he would base his appeal on the portion of the lease that stated the operation would be "in-store modeling for clients" and that accurately described the business.

More recently Noonan told the Democrat-Herald he understood there would be no appeal after all. He said once the judge signed his order, the eviction process could start right away. Noonan said, however, he would give Cunningham until noon on June 9 to move out.

Noonan said today he was perplexed that he still had not received a copy of the order signed by the judge.

"As soon as we get the order, my client will re-key and re-rent the space," he said.
